01Agreement
These Terms of Service (“Terms”) are a binding agreement between you and Bellwether, a California company (“Bellwether”, “we”, “us”), governing your use of the Bellwether mobile application and related services (the “Service”).
By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
Our Privacy Policy is incorporated by reference and forms part of these Terms.
02Bellwether is not medical advice
Read this section carefully
Bellwether is a general wellness and family-connection product. It is not a medical device, not a diagnostic tool, and not a substitute for professional medical judgment.
- Nothing in the Service — including AI-generated insights, sleep scores, stress or “Calm” readings, trend analysis and nudges — is medical advice, diagnosis or treatment.
- Never use Bellwether to diagnose a condition, to decide whether to seek care, or to make any decision about medication, treatment or therapy.
- The Service is not an emergency or monitoring system. It will not alert you to a medical emergency, and its absence of an alert means nothing. Do not rely on it to know whether someone is safe or well.
- Health figures may be missing, delayed or wrong for reasons entirely outside our control — a phone left at home, a watch that was not worn, a permission that was revoked, a background sync the operating system chose not to run, or an error in the source device.
If you or someone in your circle may be experiencing a medical emergency, call your local emergency number immediately. Do not send a nudge and do not wait for the app.
Always consult a qualified healthcare professional about any question regarding a medical condition.
03Eligibility
You must be at least 13 years old to use Bellwether. If you are between 13 and 18, you may use it only with the consent and involvement of a parent or legal guardian, and that adult accepts these Terms on your behalf.
You must be able to form a binding contract, and you must not be barred from using the Service under applicable law. By using the Service you confirm that you meet these requirements.
04Your account
- Provide accurate information and keep it current.
- You are responsible for everything that happens under your account and for keeping your credentials secure.
- One person per account. Do not share your account or let anyone else sign in as you.
- Tell us at bellwether.mobile@gmail.com immediately if you believe your account has been accessed without your permission.
If you sign in with Google or Apple, that provider's terms also apply to your use of their sign-in service.
05Health data and permissions
- Bellwether reads health data from Apple Health or Health Connect only after you grant permission on your device. It writes back one thing only: a period day you log in the app, saved to your own device's health platform so it appears in Cycle Tracking. Clearing that day in Bellwether deletes the entry again. Nothing else is ever written, and the flow you log is never uploaded to our servers.
- You may revoke that permission at any time in your device settings. Doing so stops new data being read and uploaded, and stops the app writing the period days you log. It does not delete your account, it does not remove summaries already uploaded (see §9), and period days already written stay in your health platform until you remove them there.
- Data quality is inherited. The figures shown come from your phone, your watch, or another app that wrote into your health platform. We aggregate what we are given; we cannot verify or correct it.
- Some figures are derived, not measured. Sleep scores, stress and “Calm” readings, and — for sources that record no distance — walking distance estimated from step count, are all calculated by us or by the app that supplied the data. Treat them as approximations.
- We read at most the last 30 days of history from your health platform.
06Circles and sharing
Sharing is the point of Bellwether, so please be deliberate about it.
- A connection exists only when one person invites and the other accepts. Sharing is mutual and direct — being in the same circle as someone does not, by itself, let them see your data.
- When you accept an invitation, you are choosing to share your daily health summary with that person for as long as the connection lasts. The Profile page lists exactly what they will see, and the Privacy Policy §5.2 says the same in writing.
- You may remove someone from your circle, or leave theirs, at any time. Because visibility is mutual, ending it in both directions ends the sharing completely.
- Only invite people who want to be invited. Do not invite someone to obtain their health data without their genuine, informed agreement.
- Invitations are sent to a full, exact email address and expire after 7 days.
- Joining a challenge is a separate choice to share. It shows one metric's running total, and the days you cleared the bar, to everyone else in that challenge — including people you are not connected to, because the person who set it up may have invited them from their own circle. Accept only challenges whose company you are happy to be counted in front of, and leave when you would rather not be: leaving takes your total out of the standings. Privacy Policy §5.4 sets out exactly what the others see.
6.1 Sharing on behalf of someone else
If you set up or manage Bellwether for another person — a child, an aging parent, someone who needs help with technology — you are responsible for making sure that person understands what is being shared, with whom, and that they agree. Where the law requires their consent, you must have it.
07Acceptable use
You agree not to:
Use Bellwether to monitor, track, stalk, control or coerce anyone without their knowing and ongoing consent. This is the rule we care about most, and we will terminate accounts that break it.
- Harass, threaten, abuse, or send unwanted or hostile messages through nudges or any other feature.
- Attempt to access another person's data, circle or account, or to bypass the app's sharing rules.
- Probe, scan or test the security of the Service; interfere with it; or attempt to overwhelm it.
- Scrape, harvest or enumerate user accounts or email addresses.
- Reverse engineer, decompile, or attempt to extract source code or credentials from the app, except to the extent this restriction is unenforceable under applicable law.
- Use the Service for any unlawful purpose, or in violation of Apple's or Google's platform rules.
- Use the Service or any data obtained from it to make employment, insurance, credit or other consequential decisions about another person.
- Impersonate anyone, or misrepresent your relationship to a person you invite.
- Use automated systems to access the Service other than the app itself.
08Your content
You keep ownership of what you put into Bellwether — your profile photo, display name, relationship labels and nudge messages (“Your Content”).
You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce and display Your Content solely to operate the Service — for example, showing your photo to your circle and delivering a nudge to its recipient. This license ends when you delete the content or your account, subject to routine backup rotation.
You are responsible for Your Content and confirm you have the right to share it. Do not upload anything unlawful, infringing, or that depicts another person without their permission. We may remove content that violates these Terms, but we have no obligation to monitor content and generally do not.
09Ending your use
You may stop at any time. Sign out, revoke health permission, remove your connections, or delete your account. To delete your account and everything associated with it, open Profile → Delete Account in the app and confirm; the deletion runs immediately and cannot be undone. If you cannot reach the app, email bellwether.mobile@gmail.com from your account address instead and we will complete the deletion within 30 days.
We may suspend or terminate your account if you materially breach these Terms — especially §7 — if required by law, or if your use creates a risk to other users or to the Service. Where circumstances allow, we will tell you why and give you a chance to respond.
On termination: your right to use the Service ends immediately, your connections end, and your data is deleted as described in the Privacy Policy. Sections 2, 8 (as to prior use) and 10–19 survive.
10AI features
Bellwether uses third-party AI models to generate insight text and suggested nudge messages from your daily figures (see Privacy Policy §6.2).
- AI output is generated text, not fact and not advice. It may be wrong, generic or ill-suited to your situation. Read it as a friendly comment, never as a finding.
- AI insights are subject to §2 in full: they are not medical advice.
- We limit AI requests per user per hour, and AI features may be unavailable, delayed or removed at any time.
- If AI is unavailable, the app falls back to insights computed on your own device.
11Notifications
The Service sends push notifications — invitations, nudges, and silent background messages that wake the app to sync your data. You can turn notifications off in your device settings, though doing so will make the app less useful and may delay your data reaching your circle.
12Third-party services
Bellwether depends on Apple Health, Android Health Connect, Google Sign-In, Sign in with Apple, Firebase Cloud Messaging, our hosting provider and AI providers. These are controlled by third parties under their own terms. We are not responsible for their acts, omissions, outages or changes, and a change on their side may alter or interrupt Bellwether features without notice.
If you obtained Bellwether from the App Store: these Terms are between you and us, not Apple. Apple has no obligation to provide support or handle claims relating to the app, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
13Availability and changes
We provide the Service on an ongoing basis but do not guarantee uninterrupted availability. We may add, change, suspend or discontinue features at any time. If we discontinue the Service entirely, we will give you reasonable notice and an opportunity to export your data.
The Service is under active development. Features may change and, occasionally, may not work as intended.
14Our intellectual property
The Bellwether app, its design, its name, its logo, and all associated software and content (other than Your Content and third-party materials) belong to us and are protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial purposes, in accordance with these Terms. All rights not expressly granted are reserved.
15Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement.
Without limiting the above, we do not warrant that the Service will be uninterrupted, secure or error-free; that health data will be complete, timely or accurate; that notifications will be delivered; that background syncing will run; or that any insight, score or reading will be correct or useful.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
16Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of or relating to the Service — even if we were advised such damages were possible.
- We are not liable for any harm arising from reliance on the Service to know another person's health or safety, from a notification that was not delivered, from health data that was missing or wrong, or from any medical decision made in reliance on the Service. See §2.
- Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $100.
These limits apply regardless of the legal theory and even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence, where such limitation is prohibited by law.
17Disputes
17.1 Talk to us first
Before filing anything, email bellwether.mobile@gmail.com with a description of the dispute and the resolution you want. Most problems can be sorted out this way. Both sides agree to try in good faith for 60 days before starting a formal proceeding.
17.2 Arbitration agreement
If we cannot resolve it informally, you and Bellwether agree to resolve any dispute by final and binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in California, or by videoconference or on documents at your election. The arbitrator may award any relief a court could award to you individually.
17.3 Class action waiver
You and Bellwether each waive the right to bring or participate in a class, collective, consolidated or representative action. The arbitrator may not consolidate claims or preside over any representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.
17.4 Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or to stop unauthorized access to the Service.
17.5 Opt out
You may opt out of §17.2 and §17.3 by emailing bellwether.mobile@gmail.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms. Opting out costs you nothing and affects nothing else in these Terms.
18Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Subject to §17, the state and federal courts located in California have exclusive jurisdiction, and both parties consent to venue there. If you are a consumer in the EU, UK or another jurisdiction whose law grants you the protection of your local courts and mandatory consumer law, nothing here deprives you of it.
19General
- Changes to these Terms. We may update these Terms. For material changes we will give notice in the app or by email at least 14 days before they take effect. Continuing to use the Service after that means you accept the new Terms. If you do not, stop using the Service and delete your account.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service and supersede any earlier understanding.
- Severability. If a provision is held unenforceable, it is modified to the minimum extent necessary and the rest stays in force.
- No waiver. Not enforcing a right does not waive it.
- Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
- Force majeure. Neither party is liable for failures caused by events beyond its reasonable control.
- No third-party beneficiaries, except Apple as stated in §12.
